A new bill that would phase out the sale of new gas-powered small off-road engines (SORE) by 2024 was introduced in the Assembly Monday.

Assembly Bill 1346, authored by Assemblyman Marc Berman (D-Menlo Park) and Assemblywoman Lorena Gonzalez (D-San Diego), would require the California Air Resources Board (CARB) to adopt cost-effective and technologically feasible regulations to prohibit engine exhaust and evaporative emissions from new small off-road engines. 

Specifically, the sale of new gas-powered small off-road engines, commonly found in gardening and outdoors equipment such as lawnmowers, leaf blowers, chainsaws, and other similar equipment would be transitioned over to only zero-emission motor equipment.

While gas-powered equipment would not be made illegal, the sale of new gas powered SORE would be phased out until 2024, or by a date that CARB finds acceptable. CARB would also have to make funding available for commercial rebates to support the transition to zero-emission SORE.

LOS ANGELES -- Adult film actress Riley Reyes was preparing for a "particularly physical" scene last week when she received word of a proposed state measure that would impose strict new rules on her industry.
"I was completely shocked," said Reyes, who is among "hundreds of thousands" of performers the bill initially sought to have fingerprinted, background-checked and mandated into education programs under a new licensing scheme. "It was weird to have to go to work and act sexy and normal after finding out."
Reyes shoots hardcore sex scenes on the storied sets of the San Fernando Valley, long dubbed the "porn capital of the world." She also heads the Adult Performer Advocacy Committee, one of a small number of organized labor and workers' rights groups that meet regularly with lawmakers on industry issues.
None of them knew about Assembly Bill 2389 until after it was introduced. The snub has renewed a bitter fight over who speaks for adult performers in a state where legislators have long sought to assert some control over the industry. 
After a decade of proposed porn czars and failed condom codes, strippers, adult film actors and webcam performers say Sacramento is looking for novel ways to police them.
One industry lawyer called it a "scarlet letter statute."
"It is my goal that the training required by AB 2389 will result in a certification process similar to that of other industries," Assemblywoman Cristina Garcia, a Democrat, wrote in a statement on Feb. 20, two days after she introduced the bill. "For example, the food service industry requires a food handlers training course, in which workers complete a training course and at the end take a quiz. Upon passing the quiz, they are then certified food handlers in this state."
On Thursday, Garcia introduced amendments to scrap fingerprinting requirements and scale back the business license mandate in favor of a certificate program.
But experts said such a scheme "misunderstands how the industry works."
"The industry simply isn't comparable to other jobs which require permitting," Heather Berg, assistant professor of women, gender and sexuality studies at Washington University, wrote in an email. "There is also a long history of sex workers resisting mandated registration with the state."

Democrats to force people to vote




(KTLA)  -  Following a series of sweeping expansions to expand access to voting in recent years, a California lawmaker is pushing to require voters to cast a ballot in future elections.
The proposal, introduced in the state Assembly on Tuesday, would be unprecedented and probably challenged in court should it ultimately become law. It would place the burden for determining the civil penalty and the ultimate punishment on the secretary of state, California’s chief elections officer.
“Democracy is not a spectator sport — it requires the active participation of all its citizens,” the bill’s author, Assemblyman Marc Levine (D-San Rafael), said in a written statement. “California is a national leader on expanding voting rights to its citizens. Those rights come with a responsibility by registered voters to cast their ballot and make sure that their voice is heard by their government.”

During the 2019 legislative session, California continued to pass many new laws to “normalize” illegal aliens and give them expanded rights and protections.  Governor Gavin Newsom (D) signed these measures that were vetoed by his predecessor, former Governor Jerry Brown (D), for being too extreme.
  • Senate Bill 225 allows illegal aliens to hold any “appointed civil office” and to “receive any form of compensation that the person is not otherwise prohibited from receiving pursuant to federal law.” A nearly identical bill was vetoed last year by former Gov. Brown.
     
  • Assembly Bill 668 attempts to lock Immigration and Customs Enforcement (ICE) out of state courthouses. This legislation was also previously vetoed by Gov. Brown.
     
  • Senate Bill 104 expands the health benefits to illegal aliens by making aliens aged 19-25 eligible for Medi-Cal, the state’s Medicaid program. Illegal aliens 18-years old and younger were already eligible.
     
  • Assembly Bill 1645 requires the California Community Colleges and the California State University to designate a Dreamer Resource Liaison on each of their respective campuses to help illegal alien and other immigrant students obtain financial aid and other resources such as social and legal services.
     
  • Assembly Bill 32 bans private prisons, the majority which contract with ICE to hold illegal aliens while their cases go through immigration court. 
     
  • Assembly Bill  1747 restricts the use of the California Law Enforcement Telecommunications System (CLETS) for immigration enforcement.
President Trump has noted that “in California … [t]hey don’t treat their people as well as they treat illegal immigrants.”  Former Acting ICE Director Tom Homan condemned the Golden State for “effectively making the absurd claim that it has the power to ignore federal law.” He added “California lawmakers would do well to remember that California is part of the United States.  Unless the state secedes and becomes an independent nation, it has to obey the same laws as the rest of our country.”      www.fairus.org

California state legislators passed a resolution Thursday calling on Congress to formally apologize, and for President Donald Trump to join them in acknowledging wrongdoing in separating illegal alien family units at the border
State Senators Kevin de León, Richard Pan, and Scott Wiener authored the joint resolution that was scheduled for debate, and passed on Thursday. 
KPBS reported just three legislators opposed — Joel Anderson, Mike Morrell, and Jim Nielsen — while 29 approved it, and eight didn’t vote.

The California Senate resolution calls on Congress to specifically apologize to the children separated from the adult foreign nationals who illegally brought them across the U.S. border. It also petitions Congress and President Trump to acknowledge wrongdoing in separating illegal alien adults and children.
The resolution describes the policy of separating foreign nationals who have crossed the border illegally as “detrimental.” De León described the separations as “government-sanctioned kidnapping.”

SACRAMENTO (CBS13) — A new state bill would give kids two options with their meals at restaurants—water or milk.
Senate Bill 1192 would make water or milk the default drink for kids meals in a push to reduce obesity and access to sugary drinks for children.
The bill passed the Assembly and is on its way to Gov. Jerry Brown’s desk. If he signs it, California would be the first state in the nation to have such a law.
No one gets in the way of Isaiah Palacios and his soda.
“I need my root beer, I need my Fanta, I need my Sprite,” he said.
But California lawmakers could make that sugary fix harder to get as a new effort to impact the eating habits of children gains momentum at the state Capitol.
“Cancer is fought in the halls of government, not just in the halls of the hospital,” said Stephanie Winn with the American Cancer Society.
Her group is one of many supporting the bill that would force restaurants to automatically serve water or milk with kids meals instead of juice or soda. She argues children’s meals shouldn’t come with a side order of diseases.

Secret DMV office serves lawmakers, Capitol staffers

In California, long lines are a fact of life at Department of Motor Vehicles offices across the state, but for California lawmakers and their legislative staffers, there’s an alternative.
KCRA has learned of a DMV office that is not open to the public.
It’s located inside the Legislative Office Building on N Street, adjacent to the state Capitol.
The office, inside Room 121, has no markings on the door and was locked when KCRA visited it on Thursday, but after knocking, a worker confirmed it was a DMV office and said it’s set up to handle customer complaints that escalate to the legislative branch.
However, having a private office for legislators and their Capitol staff is a source of frustration for Assemblyman Jim Patterson, R-Fresno. His request for an official DMV audit was denied when three Democrats -- Senators Ricardo Lara, of Los Angeles; Ben Allen, of Santa Monica; and Jim Beall, of San Jose -- abstained from voting.
“I've been here six years and I'm not surprised that legislators have given themselves special privileges and perks that typical Californians just don't get,” Patterson said
When asked how constituents might feel about a special office for lawmakers, Lara wasn't too sure about the office's purpose.
“Well, I think it's open to the public, if I recall,” Lara said. “I'm not sure, I haven't used it."
The special office, which has a locked door, is not open to the public.
No. Legislators don't give a shit about you.
They only shed tears for the illegal alien citizens of foreign nations.

Adopting Communist holiday pushed in California




A Democrat California assemblyman introduced a bill seeking to make “May Day,” or International Workers Day, a state holiday that would replace President George Washington’s or President Abraham Lincoln’s birthday.

Assemblyman Miguel Santiago’s (D-Los Angeles) legislation calls for consolidating the two presidents’ birthdays to be observed on the third Monday in February as a single “President’s Day” holiday, but it also calls for the state to observe May 1 as “International Workers Day.”


International Workers Day, also known as “May Day,” had been observed in countries under Communism for decades and was designated as an official holiday of the Soviet Union.

In Russia, workers still march to celebrate May Day, with more than 100,000 people coming out for the traditional May Day parade in Moscow this year.

But not everyone in the California Assembly was on board with replacing a president’s birthday with a holiday steeped in communist roots.

“Are we in competition to become the laughingstock of the United States?” Assemblyman Matthew Harper (R-Huntington Beach) asked in a floor speech Thursday. “This is ridiculous. This is insane.”

“Seriously, the substitution of adding International Socialist Workers’ Day? May Day? The day of parades in the Soviet Union?” Harper added. “I’m aghast that a bill like this would be able to make it through committee.”

Santiago’s May Day bill did not pass on Thursday, but the California Democrat made a motion for the Assembly to reconsider the legislation.

Breaking the Democrat Super-Majority in Sacramento


Republican Councilman Justin Mendes is the son of Portuguese dairy farmers. His family started dairying in the 1930s and his father was a 3rd generation dairyman. 

Can the pathetic GOP get its act together?

  • If the GOP rolls over and plays dead again the sky will be the limit for Leftist tax increases.


(Bakersfield Californian)  -  The race between 32nd District Assemblyman Rudy Salas, D-Bakersfield, and Republican Justin Mendes will be decided in November.
But their round-one face off in June will provide a critical clue about whether the Hanford Councilman and political staffer has a chance to unseat the three-term Salas.
A little political education will help here.
In the heavily Democratic 32nd District, which includes all of Kings County and the rural, Latino communities in western Kern County, Republican voters historically head to the polls at a much higher rate then Democrats.
That effect is much more dramatic in gubernatorial election years — like this one — that are scheduled halfway between Presidential elections.

48% Democrat, 26% GOP, 26% independent and small political parties.

The Republican voting advantage is even more pronounced in primary elections like the one coming up in a little more than one month.
In other words, the June 5 primary is the absolute best time for Mendes, a staffer for Republican Congressman David Valadao, to out-poll Salas in a district where Democrats have a 22.5 percent registration advantage over the GOP.
If Mendes can’t do that, then things look bleak for him in November when more Latino and Democratic voters are expected to turn out to the polls.
But Cal State Bakersfield Political Science Professor Mark Martinez said Kings County, Mendes’ home turf, is still the key to the race.
“The battlefield there is going to be Kings County,” he said. “If Rudy can maintain 35 to 40 percent in Kings he should win this thing. He’ll probably have to pull 40 percent.”
That isn’t an easy task for most Kern County Democrats.
Kings County is heavily Republican and its voters are exceptionally active.
Martinez points to a list of Democrats who’ve been “clobbered” in Kings County — and subsequently have lost races in Democratic stronghold districts that mirror nearly all of the 32nd District.
Kern County Supervisor Leticia Perez lost a State Senate election to Republican Andy Vidak in 2013.

Amanda Renteria, running for Congress against Valadao in 2014, got only 23 percent in Kings County
Emilio Huerta lost against Valadao there in 2016 with 29 percent of the vote.
Salas has topped 40 percent in Kings County in every election.
And he’s won each time.
But he hasn’t run against an opponent with roots in King’s County’s ag-powered political family.
Mendes, who worked campaigns for Valadao and, like his boss, is the son of Portugese Dairy farmers, has obviously seen the template for winning.
And he’s developed a classic middle-of-the-road campaign narrative for the Central Valley, giving his support to immigration reform and calling for DACA to be left in place and Dreamers to have a place in the U.S.
“We’re talking about hard-working individuals who work long hours and send money back to their families and pay taxes,” Mendes said. “What gets in the way of immigration reform are the extremes grabbing the microphone. We need the labor here. Unfortunately the sanctuary state law is forcing ICE to look for the bad guys among the good guys.”
He bashed Salas for voting in support of the sanctuary state bill.
And Menedes is calling for red meat Republican changes like reform of the California Environmental Quality Act, cuts to anti-business regulation and construction of more water storage projects.
He’s even issued a critique of the California High Speed Rail project.
“The budget overruns, the lack of oversight. My children (age 1 and 4) will probably never ride it,” Mendes said.
Still, he said, he will be able to operate effectively in the deep blue halls of Democrat-dominated Sacramento by reaching across the aisle.

“They will most likely lose the supermajority (in the Legislature) and they will need somebody to talk to,” Mendes said of Democracts. “I’m not going up there to be hyper-partisan.”
But Salas knows his district and opposes high speed rail, co-authored the 2014 water bond and took a political hit for voting against his party on California’s new road improvement tax.
The tax hits the poor people in the 32nd Assembly harder than it does other people because it snaps up more of their paycheck.
“They’re not always happy with me because I’m a strong, independent voice,” Salas said of his party leadership and Governor Jerry Brown.
There was tremendous pressure to vote for the bill, he said, but he stood his ground.
It cost him a chairmanship seat on a top committee.
“I was punished,” he said. “But I have no regrets.”
Salas acknowledged the challenge from Mendes, but said he’s not focused on his opponent. His focus is on serving the district.
What he’s done, he said, has given him inroads with Republicans in the 32nd District.
“I’ll walk up to a Republican house and they’ll say, “Rudy, you’re the only Democrat we’ll vote for.”
The only stance he’s taken that could cost him with Republicans is his vote for California’s Sanctuary State bill, a decision he said he stands by.
The bill restricts the type of criminals that state law enforcement agencies can transfer to Immigration and Customs Enforcement officials.
But it doesn’t, as Republicans like to claim, stop local law enforcement from transferring people with serious, dangerous convictions to ICE, Salas said.
But the impact of ICE raids to the communities he represents has been significant.
“ICE coming into our communities has stirred up a lot of emotions,” he said.
People are avoiding going out in public and businesses are suffering from the loss of revenue.
But Salas said it is critical to protect the workers who play a major part in California’s robust economy.
Salas said he hopes the voters of the 32nd District will look at his record and return him to office.
“I’ve been a proven, strong, independent voice for the Valley,” he said.
Mendes is hoping voters will look for a new voice to support.

(Breitbart California)  -  California State Senator Dr. Richard Pan (D-Sacramento) has proposed a bill, the “Online False Information Act,” that would require anyone who posts news on the Internet to verify their information through “fact-checkers.”

The bill, filed quietly in late February as SB 1424, requires all California-based websites to develop a plan to fight “fake news,” to use “fact-checkers,” and to warn readers — including via social media — of “false information.”
The bill reads as follows:
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1.
Title 14.5 (commencing with Section 3085) is added to Part 4 of Division 3 of the Civil Code, to read:
TITLE 14.5. False Information Strategic Plans
3085.
(a) Any person who operates a social media Internet Web site with physical presence in California shall develop a strategic plan to verify news stories shared on its Internet Web site.
(b) The strategic plan shall include, but is not limited to, all of the following:
(1) A plan to mitigate the spread of false information through news stories.
(2) The utilization of fact-checkers to verify news stories.
(3) Providing outreach to social media users regarding news stories containing false information.
(4) Placing a warning on a news story containing false information.
(c) As used in this section, “social media” means an electronic service or account, or electronic content, including, but not limited to, videos, still photographs, blogs, video blogs, podcasts, instant and text messages, email, online services or accounts, or Internet Web site profiles or locations.
The bill would arguably impose onerous costs on individuals and businesses alike, and would serve as a tool for censorship by subjecting dissenting opinions to review via “fact-checkers.”
It is not clear who would appoint the “fact-checkers.”
Currently, Facebook uses fact-checkers approved by the International Fact-Checking Network (IFCN), an organization run by the Poynter Institute, which in turn is funded, in part, by George Soros’s Open Society Foundation and other liberal organizations.

(San Francisco Chronicle)  -  Under the threat of becoming the first lawmaker to be expelled from the state Senate in more than 100 years, Democrat Sen. Tony Mendoza resigned Thursday after a Senate investigation found that he had engaged in unwanted sexual advances toward subordinate female staffers over the past 12 years.
In a letter to his fellow senators, Mendoza said he stepped down because he refused to participate “in the farcical investigation” pushed by his former roommate Senate President Pro Tem Kevin de León, D-Los Angeles. He accused de León, who’s challenging U.S. Sen. Dianne Feinstein in the November election, of seeking his removal to score political points with the #MeToo movement.
Mendoza, a Democrat from Artesia (Los Angeles County), is the third legislator to resign in three months following accusations of sexual harassment.
The former elementary school teacher had been on paid leave since Jan. 3 during a sexual harassment investigation that found he “more likely than not” engaged in unwanted sexual advances toward subordinate female staffers over the past 12 years. His resignation takes effect immediately.
“It’s my duty as president of this body to say that we owe every employee that basic guarantee that we as an institution will not tolerate harassment nor sweep it under the rug when it is discovered,” de León said from the Senate floor.

Sex Helps California Democrats to lose Assembly supermajority

(AP)  -  California Democrats will be without a supermajority in the Assembly for months and risk losing the two-thirds edge needed to pass tax and fee increases in the Senate.
When lawmakers return in January, they will have two vacant Assembly seats that won't be filled until at least April after Los Angeles members resigned amid sexual misconduct allegations. In the Senate, a member in a competitive district is facing a recall over his support for a gas tax increase and another could face pressure to resign depending on the results of a misconduct allegation.
"It will certainly affect votes," said Democratic Assemblyman Ken Cooley, chairman of the rules committee.
Supermajorities were needed this year to pass the gas tax increase and reauthorize the cap-and-trade program. Passing a budget only requires a simple majority.
Although the changes cut into the Democrats' legislative power, tax and fee increases are less likely to come up for votes in election years because they can be unpopular with voters.
Gov. Jerry Brown on Monday set an April 3 primary date for a special election to replace former Assemblyman Raul Bocangera, who resigned last month amid sexual misconduct allegations. If no candidate gets at least 50 percent of the vote, a general election will take place June 5, the same day as the statewide primary.
A date hasn't been set to replace Assemblyman Matt Dababneh, another San Fernando Valley Democrat, who plans to resign Jan. 1. He denies a lobbyist's allegation that he assaulted her in a bar bathroom last year.
Sen. Tony Mendoza also could face pressure to resign depending on the results of an investigation into sexual misconduct claims. He denies improper behavior.
A date hasn't been set for a recall election against Sen. Josh Newman of Fullerton. Newman's district spans parts of Los Angeles, Orange and San Bernardino counties and is highly competitive.
Democrats jammed a new set of recall rules through the Legislature this year — including one that requires the state to estimate how much a recall will cost.
