Actor Rails Against Difficulty of Opening a Small Business in California




A Small Business fights the poor economy and Big Government


Longtime actor and entrepreneur Joseph C. Phillips, a man you might recognize from “The Cosby Show” or “General Hospital,” guest hosted the Glenn Beck Program Thursday night, where he discussed “the real” American dream and the difficulties of starting a small business in today’s economy — particularly in California.
 
The “unapologetic Christian and conservative” recently opened a restaurant called Daddy J’s Wingshack, so he has first-hand insight on the subject.

Given that small businesses represent the quest for the American dream, one might imagine that our governments, local and federal, would support and encourage those attempting to open small businesses. Well — one would be wrong, at least if you live in California,” he began.

“When we opened our doors a year and a half ago we were immediately beset by bureaucrats walking in carrying mountains of documents for us to read, lengthy rules, stuff for us to sign obligating us to this tax and that tax, writing check after check after check…” he continued.
 
Phillips said he has no problem with certain government regulations — he likes to know, for instance, that the health inspector has certified that an establishment is fit for service — but there is far more to deal with than the health inspector in today’s industry.
 
“My problem with bureaucrats is…the rules and guidelines and statutes that are enforced are often a matter of who you’re talking to — whether they stayed up too late the night before, whether they got some lovin’ from their spouse or their loved one, and quite frankly, whether or not they like the way you look!” he said. “The codes [are] written so that oftentimes they conflict with one another. You go down to the Health Department, the code says one thing, then you go down to the building safety department, the code says something completely different.”
 


 
All of which leads to a state of perpetual insecurity, he said, since everyone knows it’s impossible to be in a state of 100% compliance.
 
“If some bureaucrat wants to jam you up — if some guy who’s driving a city car, who’s never risked anything in his life, never built anything — if he wants to jam you up, wants to flex a little bit, you’re going to get jammed up,” he said. “And in the same way, if some inspector decides you look cool and wants to cut you some slack, you get to skate.”
 
As an example of just one of the many taxes and regulations he has do deal with, Phillips said the county of Los Angeles sends him a county assessment bill every year, which is “a tax on everything in the store” that he owns, from the friers to the chairs.
 
“Didn’t I already pay tax on all this stuff when I purchased it originally?” he asked, predicting the audience’s question. “The answer is yes. However, now I must pay a tax on those same items, an assessment, and that assessment is paid in perpetuity.”
 
And if that’s not enough, Phillips added that the county “assess the items as if they were new,” regardless of whether the refrigerator is eight years old or whether he bought the frier used.
 
“If my restaurant burned down my insurance company wouldn’t reimburse me at that rate,” he noted.  “If I tried to sell it on the open market not one person would pay that price…But what does that have to do with the county of Los Angeles? The county assess me at that rate every every single year.” 
 
“Welcome to entrepreneurship,” he said.

Democrats: "No profit allowed for medicinal marijuana"

The People's Republic of California would take steps to regulate the sale of medical marijuana under a bill approved Monday by the state Senate, restricting cannabis dispensaries that Comrade Obama's Federal prosecutors say have grown out of control.

California voters first supported legalizing marijuana to treat illness in 1996, but Comrade Obama's Federal prosecutors recently cracked down and attacking the private property of the landlords of pot stores.
 
The industry has dared to grow enormously profitable by providing a service that people willingly want and need..

The Senate sent the bill to the Assembly on a 22-12 vote and without any Republican support.
 
The legislation makes it clear that dispensaries cannot operate at a profit, but that the owners can receive reasonable compensation and reimbursement for expenses reports The Signal - Associated Press.

"This bill is not about the legalization of marijuana," said Senate President Pro Tem Darrell Steinberg, D-Sacramento. "It does seek to assure that patients who need medical cannabis have access to it. It is intended to assure that drug cartels and other criminals do not benefit from the lack of regulation."
 
100% Bullshit.  If you did not make the business illegal then cartels would not be involved.  Alcohol cartels vanished the day prohibition ended in the 1930s.

He said his SB439, along with pending legislation by Assemblyman Tom Ammiano, D-San Francisco, is "intended to come to some sort of an understanding with the federal government."

The bill's language is still being negotiated with law enforcement groups and is likely to be amended in the Assembly, Steinberg said.

It would not affect local regulations or prohibitions on dispensaries, authority that the state Supreme Court upheld earlier this month.

The bill would adopt guidelines issued by Gov. Jerry Brown when he was the state's attorney general in 2008, making it clear that the dispensaries cannot operate at a profit. Those operating within the guidelines could not face state prosecution.

Under Brown's 2008 guidelines, cooperatives registered under the state's Food and Agricultural Code or organized as less formal "collectives" (Communist) are legal under California law, while for-profit dispensaries are not.

But there is lingering confusion over what is permitted in California, as indicated by the three competing medicinal marijuana measures that Los Angeles voters will consider on Tuesday's municipal ballot. The measures would either limit the number of dispensaries or allow new ones to open.

Some 200 cities have outlawed or restricted dispensaries.

For reasons unknown the Leftist-Socialist legislature of the People's Republic of California has made it legal to start a small food business at home and to sell homemade muffins, cakes and pies at local stores and restaurants and directly to consumers.

Slammed by the economy, many households are looking to earn a bit of money on the side with home-cooked confections — without the huge upfront costs in leasing certified commercial kitchens and complying with myriad business rules.

The Los Angeles Times reports Comrade Governor Jerry Brown signed the bill which would permit home bakers to sell as much as $50,000 worth of goods a year, as long as they don't contain cream or meat products. So far, more than 30 other states have similar laws.



The bill was inspired last year when the Los Angeles County Health Department ordered Mark Stambler to stop selling as many as 50 loaves of bread he baked each week in his backyard oven in Los Feliz. Stambler, 59, had hoped to grow his baking into a full-time business, but the Health Department closed him down.

Under the old Socialist state law, it was a misdemeanor for small-scale home cooks and bakers — often mothers and part-time workers — to make money off their creations, except to benefit charities. After all, making money is evil and capitalist.

Start-up food companies are currently required to work out of certified commercial kitchens, an expensive proposition that bars many from even trying.

"A small food company has no chance. It's impossible to make any money at all," one home baker said. She rents two kitchens to make organic and gluten-free baked goods and barely recoups her costs.

"I literally work day and night," she said. "Had I been able to just bake at home, it would have made my life so much easier."


Freedom to Jam.
The People's Republic of California now allows you to sell homemade jams, breads, fruit pies, honey and other products for profit of all things. What is stupid is it was illegal to sell these products in the first place.


The California Homemade Food Act now allows "non-potentially hazardous food" such as bread, fruit pies, empanadas, jams, honey and dried nuts to be sold out of houses, apartment complexes and other residences.

Sales of small-batch foods could spawn a lucrative industry worth hundreds of millions of dollars, supporters said. Many of the so-called Bakers Bills in other states were passed into law since the economic downturn.

Under the bill, home food producers would still have to obtain permits, label their products as homemade and offer lists of ingredients. Their gross annual sales would be capped next year at $35,000, rising to $50,000 in 2015.

Those selling directly to consumers would have to register with their local health departments and complete food handler courses. Purveyors selling through a retailer would also be subject to health department inspections.

For some strange reason the Socialist California state legislature thought it was a good idea for people to open home businesses, create wealth and pay taxes into the treasury. Maybe, just maybe, there is hope for freedom in America.

Job creators flee Socialist California



Socialist Stupidity  -  Comrade Jerry Brown does not give a crap about the average person who works for a living.

  • Brown and his Fellow Travelers in the legislature get a government paycheck.  So the fact you can't find a job has no meaning to them.
  • SHOCK  -  With 12% of the U.S. population, the People's Republic has 33% of those on welfare.



Comrade Governor Jerry Brown of the People's Republic of California released his 2012-13 budget proposal and demand for job creators to bend over for a good tax reaming by his Socialist minions.  Brown's endless quest for more and more tax money will only will force the producers of society into leaving the state.

Comrade Brown calls for $8.5 billion in tax increases from the initiative he is placing before voters on the November ballot. Most of the tax increase will come from increasing the top income tax rate by 3 percentage points.  The rest of the new taxes will come from a sales tax increase for all residents to fund the cradle-to-grave Welfare State.

The Marxist income tax would go from the current 10.3 percent to 13.3 percent, which would be the highest in the nation.  This would be on top of the already high Federal income taxes.



But he failed to note something crucial: That owners of businesses that create jobs can move away from the People's Republic. And if the jobs are not created, then the businesses die. And if the businesses and jobs are gone, then the tax base goes down.
Taxing those so-called evil capitalist "owners” more isn’t a simple matter of moving money around in separate bank accounts. It means punishing the jobs creators and totally screwing people who work for a living.
Just last week there was wide publicity given to Facebook co-founder Eduardo Saverin leaving not just a particular high-state tax, but the entire USA for tax relief in Singapore.  The nation of Singapore has no capital gains tax. He’s worth $4 billion, assuming the Facebook’s coming IPI rakes in $100 billion.

Comrade Brown also didn’t note something else: Although the economic recovery is tepid, it is a recovery. Tax revenues should be increasing a little — or at least not going down, as in California. The Wall Street Journal just reported:
“California is suffering this tax drought even as most other states enjoy a revenue rebound. State tax collections were up nationally by 8.9% last year [2011], according to the Census Bureau, and this year revenues are up by double digits in many states. The state comptroller reports that Texas is enjoying 10.9% growth in its sales taxes (it has no income tax), while California can’t seem to keep up despite one of the highest tax rates in the land.”

But he also surely knows that Democrats might gain two-thirds majorities in both houses of the Legislature this November. If that happens, they could increase taxes at will, without needing a single Republican vote in the Legislature, or the approval of voters.

California ranks last in business climate again

The business climate in the People's Republic sucks and the Marxist morons running the state have not a clue what is going on because #1)  they hate capitalism and #2) being full time political hacks they do not have to work for a living.  
In the company where my wife works outside Los Angeles two entire floors have been emptied out and closed down.  All of these California jobs were sent to the Philippines.  A friend of mine in Santa Barbara who works for a defense contractor was forced to retire.  What jobs that were left were sent to Mississippi.
But our Dear Leaders only make it worse. 
California comes in at the bottom in a business survey conducted by Thumbtack.com, in partnership with the Ewing Marion Kauffman Foundation.  The survey was conducted over two-months with over 6,000 small business owners nationwide. The data shines a new light on the United States' business regulatory climate and the nation's economic health.
“Six thousand small-business owners have told an unusually nuanced story about what they value in their state or city government,” said a spokesman for the Foundation.
California earned the a near bottom ranking in the San Francisco-based technology firm’s survey. The Golden State was one of four states to land itself a failing grade, including Vermont, Rhode Island and Hawaii.  Massachusetts earned a “D” grade.
Thumbtack.com has released new data showing that small businesses rank California among the least friendly states for small business. California earned F's in 6 of the 12 categories ranked, and the three worst cities nationwide for small businesses are all in California. The one bright spot is San Jose, which ranked in the top half of cities nationwide.
