LOS ANGELES -- Adult film actress Riley Reyes was preparing for a "particularly physical" scene last week when she received word of a proposed state measure that would impose strict new rules on her industry.

"I was completely shocked," said Reyes, who is among "hundreds of thousands" of performers the bill initially sought to have fingerprinted, background-checked and mandated into education programs under a new licensing scheme. "It was weird to have to go to work and act sexy and normal after finding out."

Reyes shoots hardcore sex scenes on the storied sets of the San Fernando Valley, long dubbed the "porn capital of the world." She also heads the Adult Performer Advocacy Committee, one of a small number of organized labor and workers' rights groups that meet regularly with lawmakers on industry issues.

None of them knew about Assembly Bill 2389 until after it was introduced. The snub has renewed a bitter fight over who speaks for adult performers in a state where legislators have long sought to assert some control over the industry. 

After a decade of proposed porn czars and failed condom codes, strippers, adult film actors and webcam performers say Sacramento is looking for novel ways to police them.

One industry lawyer called it a "scarlet letter statute."

"It is my goal that the training required by AB 2389 will result in a certification process similar to that of other industries," Assemblywoman Cristina Garcia, a Democrat, wrote in a statement on Feb. 20, two days after she introduced the bill. "For example, the food service industry requires a food handlers training course, in which workers complete a training course and at the end take a quiz. Upon passing the quiz, they are then certified food handlers in this state."

On Thursday, Garcia introduced amendments to scrap fingerprinting requirements and scale back the business license mandate in favor of a certificate program.

But experts said such a scheme "misunderstands how the industry works."

"The industry simply isn't comparable to other jobs which require permitting," Heather Berg, assistant professor of women, gender and sexuality studies at Washington University, wrote in an email. "There is also a long history of sex workers resisting mandated registration with the state."

California politician Willie Brown downplayed his past relationship with Kamala Harris, now a Democratic senator for California, as she launched her presidential campaign.

The 84-year-old former Mayor of San Francisco also claimed a role in boosting Harris’ political career in a piece published in the San Francisco Chronicle over the weekend.

Brown engaged in an extramarital affair with Harris when she was a 30-year-old prosecutor and he was in his 60s and serving as speaker of the California Assembly.

In 2003, the San Francisco Weekly reported that Brown had appointed Harris to two highly paid patronage positions in California’s state government and also appointed her to the California Medical Assistance Commission, where she attended two meetings a month for a $150,000 salary, in inflation-adjusted terms.

After their relationship ended, Brown continued to boost Harris’ career by supporting her run for district attorney and later clearing the field for Harris to become a U.S. senator when he called on former Los Angeles Mayor Antonio Villaraigosa to stay out of the Senate race.

California Democratic Party Chairman accused of sexual misconduct

(NOLA)  -  California Democratic Party Chairman Eric Bauman is facing calls to step down in the wake of sexual misconduct allegations.

Daraka Larimore-Hall, the state party's vice chairman, told The Washington Post that he sent a letter on Tuesday to the party's secretary calling for Bauman's removal after being approached by several party staff members who told him that they had been sexually harassed and assaulted by Bauman.

Larimore-Hall said he first filed a complaint with the party's human resources department and called on Bauman to step down. After Bauman refused, Larimore-Hall initiated the formal process of calling for Bauman to be ousted.

"In the days since the first brave souls have come forward, they have been joined by others with similar stories and experiences," Larimore-Hall said in the letter, calling the allegations "credible, corroborated and utterly heart-breaking."

He asked that Democrats "honor these survivors by respecting their desire to be left alone, (TRANSLATION: Keep it out of the media.) and in some cases to remain anonymous." A copy of the letter was leaked online Sunday; Larimore-Hall confirmed its contents.

Bauman has been California Democratic Party chairman since May 2017. He is the first openly gay person to lead the party in the state.

The California Democratic Party did not respond to requests for comment.

(AP)  -  California Democrats will be without a supermajority in the Assembly for months and risk losing the two-thirds edge needed to pass tax and fee increases in the Senate.

When lawmakers return in January, they will have two vacant Assembly seats that won't be filled until at least April after Los Angeles members resigned amid sexual misconduct allegations. In the Senate, a member in a competitive district is facing a recall over his support for a gas tax increase and another could face pressure to resign depending on the results of a misconduct allegation.

"It will certainly affect votes," said Democratic Assemblyman Ken Cooley, chairman of the rules committee.

Supermajorities were needed this year to pass the gas tax increase and reauthorize the cap-and-trade program. Passing a budget only requires a simple majority.

Although the changes cut into the Democrats' legislative power, tax and fee increases are less likely to come up for votes in election years because they can be unpopular with voters.

Gov. Jerry Brown on Monday set an April 3 primary date for a special election to replace former Assemblyman Raul Bocangera, who resigned last month amid sexual misconduct allegations. If no candidate gets at least 50 percent of the vote, a general election will take place June 5, the same day as the statewide primary.

A date hasn't been set to replace Assemblyman Matt Dababneh, another San Fernando Valley Democrat, who plans to resign Jan. 1. He denies a lobbyist's allegation that he assaulted her in a bar bathroom last year.

Sen. Tony Mendoza also could face pressure to resign depending on the results of an investigation into sexual misconduct claims. He denies improper behavior.

A date hasn't been set for a recall election against Sen. Josh Newman of Fullerton. Newman's district spans parts of Los Angeles, Orange and San Bernardino counties and is highly competitive.

Democrats jammed a new set of recall rules through the Legislature this year — including one that requires the state to estimate how much a recall will cost.

(The Hill)  -  The Democratic majority whip of the California State Assembly on Monday announced that he will immediately resign following allegations of sexual harassment.

In a statement posted to his Facebook page, Raul Bocanegra said he has decided to resign "effective immediately" instead of waiting until September of 2018, as he had originally announced.

“Upon further reflection during the recent holiday weekend, and conversations with family, friends, supporters, I have decided to resign earlier from the State Assembly effective immediately, which was my original intention,” Bocanegra said in the statement.

Bocanegra cited "persistent rumors" of sexual misconduct in a statement last week to the Los Angeles Times in which he initially announced his plans to resign. 

The Times earlier this month said it had contacted Bocanegra's office in reporting a story about six women who claimed they had been sexually harassed by the state lawmaker.

Bocanegra in his statement to the newspaper said he had asked California’s Assembly Rules Committee to investigate the allegations.

On Monday, Bocanegra denied that he is guilty of such crimes but said he is “admittedly not perfect.”

“I sincerely hope that my decision to resign immediately does not embolden those who are using this serious problem in our society to advance their own personal political gain, rather it is my hope that this action can instead help to widen the doors for victims of sexual assault and workplace harassment to find justice and solace,” he said.

Leftist Democrats lacked only one vote to impose their condom requirements on the film industry.

(AP) — California officials in charge of workplace safety voted down a proposal Thursday that would have specifically called for putting condoms on actors in adult films, heeding the call of scores of industry officials who said adding that and other restrictions would force them to make films nobody would watch.

The state Division of Occupational Safety and Health’s Standards Board voted the measure down when only three members supported it, Cal/Osha spokeswoman Julia Bernstein said. Four yes votes from the seven-member board were required for passage. The vote was 3-2 in favor, with one member absent and one board position currently open.

The board will now begin considering a new worker-safety measure for the industry, Bernstein said.

Board members appeared influenced by the dozens of adult-film industry representatives who filed to the dais during a public hearing in Oakland to argue forcefully but politely that adopting the condom measure would either destroy their multibillion-industry or force it underground. Doing the latter, they said, could make it more dangerous to performers by eliminating safeguards such as the industry’s requirement that actors be tested every 14 days for sexually transmitted diseases.

“I know you guys work really hard and have our best interests at stake, but we need you to work with us to find a solution,” said actress SiouxsieQ, who also reports on the industry for various publications. “When you criminalize sex work in any way, you make it more dangerous.”

Mike Stabile, a spokesman for the industry trade group the Free Speech Coalition, said after the vote that adult-film producers hope they can work closely in the future in crafting safety requirements that the industry can accept. He didn’t say what those might be.

The AIDS Healthcare Foundation has lobbied Cal/OSHA for years to adopt workplace safety standards specifically for the industry that are similar to what it has for other businesses.

Although disappointed by Thursday’s vote, foundation spokesman Ged Kenslea said his organization was impressed that adult-film industry representatives said they recognize a need for some sort of regulation. He added his group would be interested in working with them to achieve that goal.

(Washington Post)  -  California voters probably will have a chance next year to weigh in on a controversial regulation affecting a multibillion-dollar industry: whether adult film stars must wear condoms while performing.

Democrat Secretary of State Alex Padilla said Wednesday that he plans to certify a ballot measure that would put the question to voters next November after supporters gathered the required signatures to qualify for the ballot.

“The Number One way that young people learn about sex in this day and age is pornography on the Internet,” Michael Weinstein, president of the AIDS Healthcare Foundation, told the Associated Press. “In porn, real people are having real sex. They’re transmitting actual diseases, and the audience knows it. It’s not like a fictional Hollywood film.”

The Los Angeles-based AIDS Healthcare Foundation proposed the ballot measure.

The initiative was modeled after a similar measure that passed in Los Angeles County in 2012. The San Francisco Chronicle reported that the county measure “has been tied up in litigation and never enforced.” Still, the number of porn permits issued in the county for adult films dropped by 90 percent the year after the measure was approved, and some in the industry have lamented the harmful economic impact of the regulation, the Los Angeles Times reported last year.

The ballot measure could cost the state tens of millions of dollars in lost state and local tax revenue, according to the official initiative summary. It also probably would cost a few million dollars annually to administer.

The Free Speech Coalition, an industry trade group, strongly opposes the measure.

“Performers, who are currently tested every fourteen days, have long protested mandatory condom legislation, expressing that they are unnecessary given the extensive testing regimen,” the group said in a statement. “There has not been an on-set transmission of HIV in the regulated adult industry since 2004.”

The initiative would grant any state resident the right to sue over a violation of the condom mandate, prompting concerns among performers of being unduly targeted.

“If the proposed initiative were to pass, adult performers would immediately be targeted by stalkers and profiteers, who would use the initiatives’ sue-a-performer provision to harass and extort adult performers,” Diane Duke, chief executive of the Free Speech Coalition, said in the group’s statement. “This is an unconscionable initiative that would take a legal and safe industry and push its performers into the shadows.”

Ranchers in Northern California shot a wild pig and ended up finding its meat surrounded by Smurf-blue fat.

A user on Imgur posted photos and a short explanation of the bizarre discovery at their in-laws' Morgan Hill ranch. The couple cut open the pig, drained most of the blood and were startled to see fluorescent blue fat peeking out of the incision.

User GlendilTEK said the ranchers are aware blue pigmentation could be caused by copper poisoning, but there are only old mercury mine shafts near the property. Other wild pigs that were shot by the couple did not have neon blue fat.

Samples of the fat were sent off to UC Davis for testing.

LOS ANGELES — Adult film performers in California could soon be required to wear condoms and goggles to prevent exposure to bodily fluids, and producers would have to pay for medical visits and Hepatitis B treatments, under a new set of safety procedures recently released by the state Occupational Safety and Health Standards Board (Cal/OSHA).

The 21-page proposal, released by the Board on Thursday, outlines new standards for ensuring that porn performers remain safe from sexually transmitted diseases and bloodborne pathogens.

The proposal would require producers to provide condoms and other “barrier protection,” like protective eye gear, to adult film stars.

But the porn industry and its supporters say the new regulations go too far.

“These are regulations designed for medical settings, and are unworkable on an adult film set – or even a Hollywood film set,” Free Speech Coalition CEO Diane Duke said in a statement. “We’ve come to San Diego with ways to amend the regulations, with input from both performers and public health officials, in ways that protect adult film performers without stigmatizing and shutting down an entire industry.”

According to the Los Angeles Daily News, the new regulations are the result of a campaign by the AIDS Healthcare Foundation to ensure safety on adult film sets. In 2009, AHF President Michael Weinstein wrote a letter to Cal/OSHA complaining that California porn production companies were refusing to provide condoms on all adult film sets in California, elevating the risk of disease transmission. To underscore his point, Weinstein mailed 60 DVDs of California-shot porn films that did not use condoms to the regulatory agency along with the letter.

In 2012, AHF and Weinstein were instrumental in the passage of Measure B, regulation that requires condom use on all adult films shot in Los Angeles County. Efforts to pass a statewide condom law failed in an Assembly committee last year, but the organization is already working on measure to be placed on the 2016 ballot.

Five years after he mailed his letter, Weinstein told the Daily News he is “pleased” with the agency’s proposal.

“Getting to this point is a necessary part of the process, and we’re pleased that this has been completed,” he told the paper. “The process is designed to give everybody a say. I think it was conducted fairly.”

But porn industry executives and performers say existing regulations are already adequate to ensure performer safety. Actors and actresses are already required to be tested for STDs every 14 days, and are not allowed to work until receiving a clear report.

“There is already a code of honor between performers [to get tested], because you could kill someone,” actress Anya Ivy told Breitbart News at the Adult Entertainment Expo in Las Vegas earlier this year.

Still others say that increasingly tough regulations in California could force the estimated $7-13 billion adult film industry out of California and into states like Nevada and Florida, where safety standards are more relaxed.

“From a sustainability standpoint, the industry has to move to Las Vegas,” PornCareerBuilder.com’s Michael Wondercub told Breitbart News. “In general, California has higher taxes and a higher cost of living… This is a safe industry if you play by the rules and Nevada just has less regulations.”

(NPR)  -  There's an inconspicuous metal box mounted on the wall of the gym at San Francisco County Jail No. 4.

When Kate Monico Klein turns a knob, the machine releases a condom in a small cardboard packet. Machines like this one — dispensing free condoms — are installed in all of the county's male jails.

"We set [the machine] off to the side, so that people would have a minor amount of privacy," explains Monico Klein, director of HIV services for Jail Health, a division of the county's health department.

San Francisco has been distributing condoms to inmates in county jails for decades, but a new California law requires condoms to be made available to all state prisoners. California is the second state after Vermont to do so, even though sex between prisoners is unlawful here.

"I get about 10 of them every time," says Jail No. 4 inmate Robert Greve, with a laugh. He has been in and out of prison in several states, but this is the first time Greve has been locked up somewhere that provided condoms.

"Condoms are very good to have around, I think, you know? Because it's a lifesaving device," he says. "A lot of people don't care about their health, I think."

California Cops Steal Naked Photos of Women

(Contra Costa Times)  -  The California Highway Patrol officer accused of stealing nude photos from a DUI suspect's phone told investigators that he and his fellow officers have been trading such images for years, in a practice that stretches from its Los Angeles office to his own Dublin station, according to court documents obtained by this newspaper Friday.

CHP Officer Sean Harrington, 35, of Martinez, also confessed to stealing explicit photos from the cellphone of a second Contra Costa County DUI suspect in August and forwarding those images to at least two CHP colleagues. The five-year CHP veteran called it a "game" among officers, according to an Oct. 14 search warrant affidavit.

Harrington told investigators he had done the same thing to female arrestees a "half dozen times in the last several years," according to the court records, which included leering text messages between Harrington and his Dublin CHP colleague, Officer Robert Hazelwood.

Contra Costa County prosecutors are investigating and say the conduct of the officers -- none of whom has been charged so far -- could compromise any criminal cases in which they are witnesses. CHP Commissioner Joe Farrow said in a statement that his agency too has "active and open investigations" and cited a similar case several years ago in Los Angeles involving a pair of officers.

"The allegations anger and disgust me," Farrow said. "We expect the highest levels of integrity and moral strength from everyone in the California Highway Patrol, and there is no place in our organization for such behavior."

Rick Madsen, the Danville attorney for the 23-year-old San Ramon woman who was the first to report Harrington, said the implications of the case are "far-reaching and very damaging."

"The callousness and depravity with which these officers communicated about my client is dehumanizing, horribly offensive and degrading to all women," he said. "It's going to lead to another level of mistrust and skepticism to the motive of law enforcement in general."

The San Ramon woman's DUI case has already been dismissed because of the investigation into Harrington's conduct, and the CHP confirmed that one of its officers, a 5-year veteran, has been placed on "administrative duties" and is not on patrol, although they did not mention Harrington by name. Deputy district attorney Barry Grove said he expects a decision about charges against officers in the CHP probe to be made next week.

In the search warrant affidavit, senior Contra Costa district attorney inspector Darryl Holcombe wrote that he found probable cause to show both CHP officers Harrington and Hazelwood and others engaged in a "scheme to unlawfully access the cell phone of female arrestees by intentionally gaining access to their cell phone and without their knowledge, stealing and retaining nude or partially clothed photographs of them." That behavior constitutes felony computer theft, the affidavit said.

As this newspaper first reported earlier this week, the investigation began with a single incident: Harrington's conduct during the Aug. 29 arrest of the San Ramon woman. The woman discovered that photos had been stolen from her phone five days after her release, when she noticed on her iPad that the photos had been sent to an unknown number. A record of the messages had been deleted from her iPhone, but the phone had been synced to the iPad.
